{"id":4222,"date":"2018-09-04T19:33:35","date_gmt":"2018-09-04T19:33:35","guid":{"rendered":"https:\/\/dementes.programate.pe\/?p=4222"},"modified":"2026-07-09T20:50:17","modified_gmt":"2026-07-09T20:50:17","slug":"reforma-historica-personas-con-discapacidad-recuperan-autonomia-para-ejercer-sus-derechos","status":"publish","type":"post","link":"https:\/\/dementes.programate.pe\/en\/2018\/09\/04\/reforma-historica-personas-con-discapacidad-recuperan-autonomia-para-ejercer-sus-derechos\/","title":{"rendered":"Historic reform: People with disabilities regain autonomy to exercise their rights."},"content":{"rendered":"<p class=\"translation-block\">Today is a historic day for Peru! <strong><span style=\"color: #2289a3\">The Executive Branch approved Legislative Decree No. 1384, which recognizes and regulates the legal capacity of persons with disabilities and promotes their inclusion<\/span><\/strong>, introducing 63 amendments to the Civil Code and replacing the classification of \u201cabsolute and relative incapacity\u201d with \u201cfull and restricted capacity.\u201d This means that, from now on, persons with disabilities <strong><span style=\"color: #2289a3\">will be able to exercise their rights fully, autonomously, and under equal conditions, eliminating the figure of legal guardianship<\/span><\/strong>.<\/p>\n<p><iframe title=\"\u25ba \u00a1ADIOS A LA INTERDICCI\u00d3N DE LAS PERSONAS CON DISCAPACIDAD!\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/53Lu4swxaQA?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<p class=\"translation-block\">The reform establishes that, from this date forward, persons with disabilities will no longer require a representative, previously known as a \u201cguardian,\u201d to exercise rights such as voting, buying or selling property, getting married, making a will, among others. Now, <strong><span style=\"color: #2289a3\">they will be able to exercise these rights without a third party making decisions on their behalf; only when they require it, they may have access to a \u201csupport person\u201d<\/span><\/strong> (individuals who provide assistance and are chosen by persons with disabilities) <strong><span style=\"color: #2289a3\">and\/or \u201csafeguards\u201d<\/span><\/strong> (measures designed to ensure respect for the rights, will, and preferences of the person receiving support).<\/p>\n<p class=\"translation-block\">The Legislative Decree <span style=\"color: #2289a3\"><strong>also eliminates involuntary institutionalization of persons with disabilities<\/strong><\/span> and establishes that, from now on, any person may <strong><span style=\"color: #2289a3\">request the reversal of legal guardianship measures<\/span><\/strong> imposed on persons with disabilities before the entry into force of this regulation, allowing for the designation of appropriate support and safeguards.<\/p>\n<p class=\"translation-block\">In a <span style=\"text-decoration: underline\"><a href=\"https:\/\/www.ohchr.org\/SP\/NewsEvents\/Pages\/DisplayNews.aspx?NewsID=23501&amp;LangID=S\" target=\"_blank\" rel=\"noopener noreferrer\">statement issued today<\/a><\/span> by <strong><span style=\"color: #2289a3\">the Office of the United Nations High Commissioner for Human Rights<\/span><\/strong>, the Special Rapporteur on the rights of persons with disabilities, Catalina Devandas, recognized this reform as \u201ca <strong><span style=\"color: #2289a3\">milestone in recognizing the full citizenship of persons with disabilities<\/span><\/strong>.\u201d She also highlighted that it represents \u201can <strong><span style=\"color: #2289a3\">example for all States to follow<\/span><\/strong>,\u201d as it \u201crecognizes the legal capacity of all persons with disabilities, eliminates restrictive systems that limit their rights, and provides the necessary support for them to make their own decisions.\u201d<\/p>\n<p class=\"translation-block\">This new regulation represents <strong><span style=\"color: #2289a3\">a turning point in efforts toward social inclusion, reducing stigma, and preventing discrimination<\/span><\/strong>, clearly distinguishing disability from incapacity. <strong><span style=\"color: #2289a3\">We wholeheartedly congratulate our friends at <a style=\"color: #2289a3\" href=\"https:\/\/www.facebook.com\/sodisperu\/\" target=\"_blank\" rel=\"noopener noreferrer\">SODIS<\/a> and everyone involved in this important reform!<\/span><\/strong><\/p>\n<div><span style=\"color: #2289a3;\">#EveryoneForMentalHealth<\/span><\/div>\n<div><span style=\"color: #2289a3;\">#DisabilityIsNotInability<\/span><\/div>","protected":false},"excerpt":{"rendered":"<p>Un hito para el Per\u00fa: el poder Ejecutivo aprob\u00f3 el Decreto Legislativo 1384 que reconoce y regula la capacidad jur\u00eddica de las personas con discapacidad y promueve su inclusi\u00f3n, modificando en 63 puntos el C\u00f3digo Civil y eliminando la figura de la interdicci\u00f3n.<\/p>","protected":false},"author":4,"featured_media":6539,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"inline_featured_image":false,"footnotes":""},"categories":[8],"tags":[23],"class_list":["post-4222","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-novedades","tag-articulos-noticias"],"acf":[],"_links":{"self":[{"href":"https:\/\/dementes.programate.pe\/en\/wp-json\/wp\/v2\/posts\/4222","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/dementes.programate.pe\/en\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/dementes.programate.pe\/en\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/dementes.programate.pe\/en\/wp-json\/wp\/v2\/users\/4"}],"replies":[{"embeddable":true,"href":"https:\/\/dementes.programate.pe\/en\/wp-json\/wp\/v2\/comments?post=4222"}],"version-history":[{"count":4,"href":"https:\/\/dementes.programate.pe\/en\/wp-json\/wp\/v2\/posts\/4222\/revisions"}],"predecessor-version":[{"id":6540,"href":"https:\/\/dementes.programate.pe\/en\/wp-json\/wp\/v2\/posts\/4222\/revisions\/6540"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/dementes.programate.pe\/en\/wp-json\/wp\/v2\/media\/6539"}],"wp:attachment":[{"href":"https:\/\/dementes.programate.pe\/en\/wp-json\/wp\/v2\/media?parent=4222"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/dementes.programate.pe\/en\/wp-json\/wp\/v2\/categories?post=4222"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/dementes.programate.pe\/en\/wp-json\/wp\/v2\/tags?post=4222"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
